These terms govern the use of Kitwerk, whether the account uses the free or paid tier.
Kitwerk is provided by Robert Paul Kothe Video & Foto, proprietor Robert Paul Kothe, Proskauer Straße 25, 10247 Berlin, Germany, email hello@kitwerk.app, German VAT ID DE274618728. The same address is the contact point for users and authorities under the Digital Services Act. German and English are accepted. Kitwerk is for adults and businesses; users must be at least 18.
Kitwerk is software for managing technical equipment, its condition, loans, packing lists and related documents. Any rental or loan between users is exclusively their contract. Kitwerk does not hold deposits, process payment for those contracts, or guarantee equipment condition, availability or return. This does not limit Kitwerk's own duties for its service under section 11.
An account is required. Registration details must be accurate; credentials must be kept confidential. Accounts are not transferable. The contract language is the German or English language expressly selected for the order. We provide the documents and contract confirmation in that language. The two language versions are intended to be equivalent; the version agreed for the particular contract governs. Mandatory consumer rights remain unaffected.
Account management at /account remains available without accepting amended terms. It provides inventory export, access to accepted documents, cancellation, withdrawal and account deletion. Other data copies may be requested at hello@kitwerk.app. Deletion is subject to the retention exceptions in the privacy notice.
The free tier allows up to 25 active equipment items; archived items do not count. New accounts receive 14 days of Pro features without payment details. The free trial ends automatically and does not turn into a paid subscription. Existing items remain readable and exportable afterwards, but additional items cannot be created beyond the free limit.
Pro is a paid subscription to a continuously provided digital service. The scope, EUR base price and total amount shown before the final payment button govern the order. The total shown for the first payment includes applicable indirect taxes; Kitwerk adds no separate subscription fee. If Stripe offers payment in another currency, Checkout shows the amount and currency of that first payment before the order. For later subscription payments Stripe converts the agreed EUR base price again using the exchange rate applicable to each billing cycle; the amount charged in the payment currency can therefore change from month to month. Stripe's exchange rate may include a conversion fee. Any additional foreign exchange fee imposed by the customer's bank is outside Kitwerk's control.
Robert Paul Kothe Video & Foto is the provider and contractual counterparty for Kitwerk Pro. For a purchase using Stripe Managed Payments, Sold through Link, LLC is the merchant of record for the transaction. Link facilitates the sale and payment on our behalf, collects applicable indirect taxes in the jurisdictions covered by Stripe, sends payment receipts and invoices, and handles payment-related enquiries. Kitwerk remains responsible for providing the service, product defects and customers' statutory rights. The issuer shown on a specific invoice or receipt governs that document; Kitwerk does not promise that every document in every country is issued in one uniform capacity.
Kitwerk's order page summarises the plan, initial price, term, automatic continuation, later price and cancellation, then opens Stripe Checkout, embedded for both plans with a summary that remains visible. Only the final payment button there submits a paid order. We accept the paid order by providing the contract confirmation by email. Pro is activated only after that confirmation has been provided. The confirmation contains the actual first payment, agreed EUR base prices, initial period, continuation and the full contractual documents. Before the final button, Checkout must clearly show all material subscription terms, including the later monthly price. Payment details are entered with Stripe/Link and are not stored by Kitwerk. The Link customer terms shown in Checkout also apply to the payment process; they do not restrict statutory claims against Kitwerk as service provider.
Purchases are possible only for products and customer locations for which Managed Payments Checkout is enabled. The country declared before Checkout must match your actual residence or business location. If the later billing address indicates an unsupported country, contact us; we will clarify availability and, if we cannot provide the service, refund the payment without deduction. Existing valid contracts remain unaffected.
The monthly plan charges the monthly price shown at purchase for each monthly billing period. It runs indefinitely. It can be cancelled at any time effective at the end of the period already paid for. Unless cancelled, it continues and is billed monthly.
The annual offer charges the price shown at purchase in advance for the first 12 months. Afterwards, Pro continues indefinitely without a new order, billed monthly at the EUR base price shown as the subsequent monthly price before the final payment button at the original purchase. This EUR continuation price is recorded for the order. If payment is made in another currency, Stripe converts it again for each monthly payment; the local amount is not locked to the converted amount shown at the original purchase. A later change to the price offered to new customers does not change the agreed EUR continuation price. Changing that EUR price for an existing subscription requires a separate valid agreement; silence does not mean consent to a higher EUR price.
Ordinary cancellation during the prepaid first 12 months takes effect at the end of those 12 months and prevents the first monthly charge. After the switch, cancellation can take effect at the end of the paid monthly period. Ordinary cancellation alone does not give a proportional refund of a paid period. Statutory withdrawal, remedies for defects in the digital service, extraordinary termination and other mandatory refund rights remain unaffected.
Kitwerk's cancellation button is available without login and permits ordinary or extraordinary cancellation. It leads to a confirmation page and electronic acknowledgement. Customers can also declare cancellation to Kitwerk at hello@kitwerk.app. Link may offer separate subscription self-service. Using it is not required for a timely cancellation received by Kitwerk to be effective. We will prevent an unauthorised subsequent charge and resolve discrepancies with Link.
Consumers also have the statutory withdrawal right explained in the withdrawal notice. The withdrawal button is accessible without login during the statutory period. Link may also accept payment-related refund requests and may refund beyond statutory entitlements under its own policy; statutory declarations to Kitwerk remain effective. Refunds normally use the original payment method unless the law permits otherwise and a different free method has been expressly agreed.
Users retain their rights in inventory data, photos, documents, packing lists, contributions and Setwerk/Scriptwerk production materials, including reference images, board photos, backgrounds and scripts. Upload only content you may lawfully store and share. Consider copyright, confidentiality, personal data and the rights of people depicted; owning a copy does not necessarily grant permission to publish it.
You grant Kitwerk a non-exclusive worldwide licence, limited to operating the functions you use, to store, back up, synchronise and technically adapt content for display, format and transfer, to make requested exports and to display it to the recipients you select. Necessary hosting and processing providers may carry out these operations on our behalf. Private uploads do not by themselves authorise public publication. Catalogue publication requires a separate express selection. Content is not used for advertising or AI training without a separate express basis. Optional AI image processing requires a separate user request and is explained in the privacy notice.
Display rights end when the contribution or share is withdrawn. Copies already lawfully downloaded by recipients cannot be remotely recalled. Limited evidence may be retained for six months after withdrawal where needed for reports or claims, or until an open dispute ends; backup deletion follows the applicable cycle.
Unlawful content and violations of these terms may be reported to hello@kitwerk.app. Include the exact URL or identifier, a substantiated explanation, your name and an electronic contact, and a statement that you believe the information to be accurate and complete. Where law permits omission of identity, we do not require it. The same address is the German- and English-language contact for users and authorities.
Where a contact address is provided, we acknowledge receipt without undue delay and communicate the decision and available remedies. Restrictions may include hiding or reducing visibility, restricting contributions or suspending an account, proportionately to seriousness and repetition. An affected person receives reasons including the material facts, applicable rule, scope and duration, any relevant automated assistance and available remedies. You can request reconsideration at the same address. This voluntary review does not restrict judicial or applicable out-of-court remedies. An independent second reviewer is not promised unless one is actually assigned.
Human reviewers decide reports about published user contributions. The optional AI image function separately uses automated safety and suitability checks and can reject images; you may contact support about a rejection.
Kitwerk hosts user information and makes selected content public at users’ request. To the extent these functions constitute an online platform, the applicable DSA duties apply. Any exemption for micro or small enterprises depends on the actual statutory criteria, not this statement. Article 24(3), including information to the competent authorities on request, remains applicable despite Article 19; exemptions from periodic transparency reports are separate.
Experience reports are ranked using explicit helpfulness confirmations by signed-in users, matching roles, an author's declaration of owning the equipment, and recency. Confirmations are dampened so reach alone does not determine ranking. Packing-list suggestions use only a workspace's own prior use and technical features. Network offers are sorted by broad region: same region, same country, then farther away. There are no paid placements. These ranking criteria cannot currently be personalised; an explanation is shown with each contribution.
Experience reports are individual reports, not verified product reviews. Kitwerk does not verify purchase or use. A displayed ownership claim is provided by its author and not checked. An account is required to post.
Kitwerk is operated with due care but uninterrupted availability is not guaranteed. Maintenance is announced where possible. Mandatory rights concerning defects, updates during the supply period, termination and remedies for digital products remain unaffected.
Kitwerk has unlimited liability for intent, gross negligence, injury to life, body or health, and where the Product Liability Act applies. For simple negligence, liability applies to breach of an essential contractual obligation and is limited to typical foreseeable damage. There is no agreed monetary cap. Users should also back up their data; complete inventory export is available in settings. The unlimited-liability cases above remain unaffected. In other cases, reasonable available backup options and statutory contributory-fault rules may be taken into account; Kitwerk’s own contractual backup and recovery duties remain unaffected.
Changes to the contract require a valid agreement unless a specific statutory basis permits otherwise. Silence does not constitute acceptance. We announce proposed material contractual changes on a durable medium at least six weeks before the proposed effective date. Declining an amendment does not itself remove access to already contracted service or account-management rights.
Changes to a continuously supplied digital product beyond necessary maintenance must meet the applicable statutory conditions, including a contractual basis with a valid reason, no additional cost, clear information and, where required, advance information on a durable medium and the statutory right to terminate. Mandatory rights under sections 327 et seq. BGB remain unaffected. These conditions do not give a general right to change the price or core service.
Accepted wording, language, version, full SHA-256 hash and the recorded acceptance time can be viewed through account management.
Public serial-number search only shows equipment whose owner has personally reported it stolen. A result is not an official finding, proof of a crime or an allegation against the current possessor. No suspected person is named publicly or in incoming notices. Objections can be sent to hello@kitwerk.app. Inaccurate or resolved reports are removed promptly. The owner can end a report at any time.
A user acting outside exclusively personal or household activities who enters third-party personal data, such as borrowers' or customers' contact details, is responsible for those data; Kitwerk processes them on its behalf. The Article 28 GDPR data processing agreement under “Legal” applies. It is expressly accepted when business use is selected, before third-party personal data are processed for that purpose. The accepted version and time are visible in the account. The data processing agreement prevails for this processing where it differs from these terms.
German law applies, without removing mandatory consumer protections in the consumer's country of habitual residence. Kitwerk is neither obliged nor willing to participate in consumer arbitration. The European Online Dispute Resolution platform closed on 20 July 2025. Berlin is the exclusive venue only where the customer is a merchant, a public-law legal person or a public-law special fund. Statutory venues apply to consumers. If one provision is invalid, the others remain effective.
